By accessing or using Triviyo ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
Triviyo is a software-as-a-service (SaaS) platform that provides booking and scheduling management tools for experience-based businesses. The Service includes:
- Online booking system and management tools
- Customer management and CRM features
- Payment processing through third-party providers
- Email and SMS communications
- Analytics and reporting
- Integration with third-party services
3. User Accounts
3.1 Account Creation
You must create an account to use the Service. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
3.2 Account Requirements
You must be at least 18 years old and have the legal capacity to enter into contracts.
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities.
4. Subscription and Billing
4.1 Subscription Plans
We offer various subscription plans with different features and pricing. Current plans and pricing are available on our website.
4.2 Free Trial
New accounts may be eligible for a free trial period. After the trial, you must subscribe to a paid plan to continue using the Service.
4.3 Billing
- Subscriptions are billed monthly or annually in advance
- Payment is processed automatically through your chosen payment method
- All fees are in USD unless otherwise stated
- You authorize us to charge your payment method for all fees
4.4 Renewals
Subscriptions automatically renew at the end of each billing period unless canceled. You will be charged at the then-current rate.
4.5 Price Changes
We may change our pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
4.6 Taxes
Fees do not include applicable taxes. You are responsible for all taxes, duties, and assessments.
5. Refunds and Cancellation
5.1 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
5.2 Refund Policy
- Monthly Subscriptions: No refunds for partial months
- Annual Subscriptions: Pro-rated refunds available within 30 days of purchase or renewal
- Trial Periods: No charges during trial; cancel anytime before trial ends
5.3 Effect of Cancellation
Upon cancellation:
- Access to the Service continues until the end of your billing period
- Your data is retained for 30 days for account recovery
- After 30 days, data may be permanently deleted (see Privacy Policy)
6. User Content and Conduct
6.1 Your Content
You retain ownership of all content you submit to the Service. By submitting content, you grant us a license to:
- Store, process, and display your content
- Provide the Service to you
- Make backups and ensure data security
- Aggregate anonymized data for analytics
6.2 Prohibited Conduct
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload malicious code or viruses
- Attempt to gain unauthorized access
- Interfere with the Service or other users
- Use the Service for fraudulent activities
- Resell or redistribute the Service
- Scrape or harvest data from the Service
6.3 Content Responsibility
You are solely responsible for your content and its legality, reliability, and appropriateness. We do not pre-screen content but reserve the right to remove content that violates these Terms.
7. Payment Processing
7.1 Third-Party Processing
Payment processing is handled by Stripe. By using our payment features, you agree to Stripe's Terms of Service and Privacy Policy.
7.2 Platform Fees
We may charge platform fees on bookings processed through our Service. Current fee structures are available in your account settings.
7.3 Payout Schedule
Payouts are processed according to Stripe's payout schedule, typically 2-7 business days after a booking is completed.
7.4 Chargebacks and Disputes
You are responsible for handling customer disputes. We may withhold funds or suspend your account if excessive chargebacks occur.
8. Intellectual Property
8.1 Our IP
The Service, including its design, functionality, and content (excluding user content), is owned by us and protected by copyright, trademark, and other intellectual property laws.
8.2 License to Use
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes, subject to these Terms.
8.3 Restrictions
You may not:
- Copy, modify, or create derivative works
- Reverse engineer or decompile the Service
- Remove or alter any proprietary notices
- Use our trademarks without permission
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including:
- Warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement
- Warranties regarding accuracy, reliability, or availability
- Warranties that the Service will be uninterrupted or error-free
We do not guarantee that the Service will meet your requirements or that any errors will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Loss of profits, revenue, or data
- Business interruption
- Loss of goodwill or reputation
- Cost of substitute services
Our total liability for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow limitation of liability for consequential damages, so these limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Triviyo, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your content or conduct
12. Governing Law and Dispute Resolution
12.1 Governing Law

We are not liable for failure to perform due to circumstances beyond our reasonable control (natural disasters, war, terrorism, labor disputes, internet outages, etc.).
13.6 Survival
Provisions that by their nature should survive termination (payment obligations, limitations of liability, indemnification) shall survive.
